1. Acceptance of Terms

Welcome to the Timemage time management application (hereinafter referred to as the "Service"). This service is provided by the Timemage team (hereinafter referred to as "we" or "Company"). By accessing, downloading, or using our service, you (hereinafter referred to as "User" or "You") agree to be bound by these Terms of Service (hereinafter referred to as "Terms").

If you do not agree to any part of these Terms, please do not use our service. We reserve the right to modify these Terms at any time, and modified Terms will take effect immediately upon publication.

2. Service Description

2.1 Core Features

Timemage provides the following core features:

  • Time Tracking: Accurately record time spent on various activities
  • Data Analysis: Generate detailed time usage reports and statistics
  • Project Management: Organize and manage work projects and task categories
  • Cross-device Sync: Synchronize data across multiple devices
  • Team Collaboration: Support time data sharing among team members

2.2 Service Tiers

  • Free Version: Provides basic time tracking features with certain usage limitations
  • Premium Version: Provides full features, including advanced analytics, unlimited projects, etc.

3. User Accounts and Responsibilities

3.1 Account Registration

  • You must provide accurate, complete, and up-to-date registration information
  • You are responsible for maintaining the accuracy of account information
  • Each account is for personal use only and may not be shared with others
  • You must be at least 13 years old to register an account

3.2 Account Security

  • You are responsible for protecting the security of your account password
  • Do not share login credentials with others
  • If you discover unauthorized account access, notify us immediately
  • You are responsible for all activities under your account

3.3 Prohibited Activities

When using our service, you must not:

  • Violate any applicable laws or regulations
  • Infringe upon others' intellectual property or other rights
  • Upload malware or conduct cyber attacks
  • Attempt unauthorized access to other users' accounts or data
  • Interfere with or disrupt the normal operation of the service
  • Use automated tools to excessively access our service
  • Engage in commercial espionage or competitive analysis

4. Paid Services and Billing

4.1 Subscription Fees

  • Premium version is charged monthly or annually, specific prices are available on the in-app pricing page
  • All fees are charged in USD through Apple App Store or Google Play
  • Fees may vary by region, exchange rates, or tax policies

4.2 Auto-renewal

  • Subscription services use an auto-renewal model
  • You can cancel auto-renewal at any time in the app store settings
  • Cancellation will take effect at the end of the current billing cycle
  • We will send a reminder notification 24 hours before renewal

4.3 Refund Policy

  • Apple App Store: Refunds are handled through Apple's refund policy. You can request a refund through Apple's website or by contacting Apple Support within the applicable refund period (typically 7-14 days for subscriptions).
  • Google Play Store: Refunds are handled through Google's refund policy. You can request a refund through Google Play Store within 48 hours of purchase, or contact Google Support for subscription refunds.
  • Special Circumstances: For refund requests under special circumstances (e.g., technical issues preventing app use), please contact our customer service team at service@timemage.net. We will review each case individually.
  • No Refund for Violations: Accounts terminated for violating Terms of Service are not eligible for refunds.
  • Cancellation: You can cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of the current billing period, and you will continue to have access to Premium features until then.

4.4 Subscription Management

  • Subscriptions are managed through Apple App Store or Google Play Store
  • You can view, modify, or cancel your subscription through your device's app store account settings
  • We do not have direct access to manage your subscription - all subscription management must be done through the app store
  • Price changes will be communicated to you at least 30 days in advance

5. Intellectual Property

5.1 Our Intellectual Property

  • The Timemage application, trademarks, designs, and technology are protected by intellectual property laws
  • You may not copy, modify, distribute, or create derivative works
  • All rights are reserved to Timemage and its licensors

5.2 User Content

  • You retain ownership of all content you upload to the service
  • You grant us the necessary license to use such content to provide the service
  • You ensure that uploaded content does not infringe upon any third-party rights

6. Service Availability and Maintenance

6.1 Service Level

  • We strive to maintain 99.9% service availability
  • Regular system maintenance and updates will be notified to users in advance
  • We are not liable for service interruptions due to force majeure

6.2 Technical Support

  • Free users enjoy community support and basic documentation
  • Paid users enjoy priority email support
  • Enterprise users can access dedicated customer success managers

7. Data Ownership and Use

7.1 User Data Ownership and Local Storage

  • You have full ownership of all time tracking data created through Timemage
  • All your time tracking data, project information, and activity records are stored locally on your device
  • We do not store, access, or process your time tracking data on our servers
  • You have complete control over your data - you can export, delete, or modify it at any time through the app
  • Your data remains on your device even if you uninstall the app (until you manually clear app data)

7.2 Data Use Restrictions

  • We do not have access to your time tracking data since it's stored locally on your device
  • We will not use your personal data for commercial purposes
  • Aggregated and anonymized analytics data (app usage, crashes, performance) may be used to improve services
  • We will not analyze the content of your time data to gain business insights (we cannot access this data)
  • Authentication data (email, name) is only used for account management and is stored locally after login

8. Service Termination

8.1 User-initiated Termination

  • You can delete your account and stop using the service at any time
  • After account deletion, we will handle your data according to the Privacy Policy
  • Please ensure you back up important data before deletion

8.2 Service-initiated Termination

We may suspend or terminate your account under the following circumstances:

  • Violation of these Terms of Service
  • Long-term inactivity (no login for more than 2 years)
  • Suspected fraud or abuse
  • Required by law or regulatory order

9. Disclaimer and Limitation of Liability

9.1 Service Provided "As Is"

  • We strive to provide reliable service but do not guarantee complete accuracy or uninterrupted operation
  • We are not liable for any direct or indirect losses resulting from use of the service
  • Users should back up important data

9.2 Limitation of Liability

  • Our total liability does not exceed fees paid by the user in the past 12 months
  • We are not liable for indirect, incidental, special, or consequential damages
  • We are not responsible for the availability or performance of third-party services

10. Dispute Resolution

10.1 Applicable Law

These Terms are governed by the laws of the jurisdiction where the Company is located, without regard to conflict of law principles.

10.2 Dispute Resolution Methods

  • Disputes should first be resolved through friendly negotiation
  • If negotiation fails, disputes shall be submitted to the court where the Company is located
  • Small disputes can be resolved through online mediation platforms

11. Terms Modification

We reserve the right to modify these Terms of Service at any time. Significant changes will be notified to you through:

  • In-app push notifications
  • Email notifications to your registered email
  • Official website announcements

Continued use of the service indicates your acceptance of the modified terms. If you do not agree to the modifications, you may stop using the service and delete your account.

12. Severability

If any part of these Terms is deemed invalid or unenforceable, the remaining parts will remain fully effective. Invalid parts will be interpreted as the closest enforceable terms to the original intent.

13. Entire Agreement

These Terms of Service constitute the entire agreement between you and us regarding the use of the service, superseding all prior agreements and understandings. Any modifications to these Terms must be made in writing.
